General
These terms and conditions may be amended from time to time and apply to all of our services. By accessing, browsing, using and/or completing a reservation with us you acknowledge that you have read, understood and agreed to the terms below. Party Pirates San Blas is the trading name of Wild Card Sailing, operating the boats Wild Card and Sovereign Grace.
Cancellation by passenger
If you need to cancel your trip for any reason, notify us at the earliest possible opportunity. Your reservation deposit is refunded only if we can replace your space on board with another passenger paying the same rate. No refund applies if the space is filled by a third-party agency to which a commission is paid, or if a discount is applied to the replacement reservation.
Cancellation or delay by operator
In very rare cases your trip may need to be cancelled or delayed in advance owing to events including, but not limited to: mechanical failure, sickness or unavailability of crew, unsafe sailing conditions, local protest or industrial action, or closure of a government department (immigration or port authority).
Prepaid deposits are not refunded in the case of civil disobedience, government action or force majeure. In these cases a transfer to another departure date is offered instead.
Illegal activities
Illegal drugs are not permitted, including marijuana. All passengers and luggage are searched by police before boarding. If any illegal substances are found, you will be refused passage and no refund will be issued.
You may bring your own alcoholic beverages. For safety reasons the captain may ask you to restrict alcohol consumption in any situation deemed unsafe.
If at any time during the trip you feel the actions of another person are unsafe, threatening or inappropriate, report it IMMEDIATELY to the captain. This includes fellow passengers, crew, members of the public and other tourists on the islands. We are unable to address incidents after the trip.
Assumed risk & outdoor activities
All activities are undertaken entirely at your own risk. Passengers must behave in a fit and proper manner at all times, follow the guidelines of the captain and crew, and take proper responsibility for their own safety. All adventure tours and outdoor activities carry inherent risks, and Party Pirates San Blas / Wild Card Sailing and its partners do not assume responsibility for accidents caused by customers, traceable to their own actions, or caused by factors outside human control (force majeure).
By undertaking the trip you agree to these conditions, understand their implications and accept responsibility for your participation. Depending on the excursion, you may be asked to sign an additional liability release.
Passport, visa and immigration
You must have a full passport (and visa, if applicable) with sufficient validity to enter and exit all countries on your booking. Contact the relevant embassy or consulate for entry requirements. You are responsible for obtaining the correct documentation; we accept no liability if you cannot travel or are delayed because of a failure to comply with passport, visa or immigration requirements.
Insurance
Passengers must have adequate travel insurance covering unforeseeable losses including, but not limited to: loss, theft or damage to personal property, medical costs from accident or illness on board or on the islands, and costs incurred due to delay such as missed transport connections.
Promotional codes
Special offers such as promotional codes cannot be applied afterwards in the form of a refund. Promotional codes and other special offers must be applied at the time of booking to be valid.
Third-party providers
We may offer third-party services such as transport to or from the start or end of your trip. These are operated by independent operators and you are free to make your own arrangements. We are not responsible for lost or damaged items or other incidents involving third-party services.
Right to refuse travel
In the reasonable exercise of our discretion, we may refuse to carry you or your luggage before or during your trip if one or more of the following has occurred, or we reasonably believe may occur:
- such action is necessary to comply with applicable government laws, regulations or orders, including advice from authorities in the destination country that your immigration status may result in refusal of entry;
- carrying you or your luggage may endanger or affect the safety or health, or materially affect the comfort, of other passengers or crew;
- your mental or physical state, including impairment from alcohol or drugs, presents or appears to present a hazard or risk to yourself, passengers, crew, the boat or property;
- you have refused a security check of yourself or your luggage, or failed to give satisfactory answers to security questions from crew, law enforcement or other officials;
- you do not appear to have valid or lawfully acquired travel documents, destroy your travel documents during the trip, or refuse to surrender them to the crew when requested;
- you fail to observe, or obstruct, our instructions regarding safety or security, before boarding or on board;
- you use threatening, abusive or insulting words or behaviour towards crew, passengers or members of the public before or during the trip;
- you fail or refuse to give us information that a governmental authority has lawfully asked us to provide about you;
- you have previously committed one of the acts or omissions above.
